22.03.2011 - Draft Reply & Site Inspection

1. For LU Appendix II items, Vent duct projection over the pavement. Vent duct itself is not a building works, it should be the associated supporting frames. Therefore, LU II item should be the metal frame supporting the vent duct projecting over the pavement. And, regarding the projection beyond building line, 600mm from building line for vent duct it tolerable. According to FEHD requirements, if canopy does exists, vent duct should project to the edge of the canopy.And so, BD will accept this so to in line with FEHD requirement. 
2. For step encroachment, previously it was included into LU II item. After reviewing the EB works and consulted the relevant department (LandsD), since BD is governing the building works in private land, but the tolerable projection 300mm for step encroachment is beyond the site boundary and therefore no action will be taken by this department. Separate action may be taken by relevant department and we are not in the position to comment those works outside lot.
3. Sliding door is valid as an exit, but it is limited to shopfront only. When no. of persons accommodated in the licensed area are more than 30P, sliding door should be kept open during the business hour so to fulfilled the requirement "swing into the direction of exit", if less than 30P, no special requirement is needed.

Further to my previous entry. By confirming with Madam, Kathy Choi, Notifiable workplace does not limited to Restaurant Kitchen only but also the seating accommodation. LU previously discussed in a forum and consulted DoJ, General Restaurant is regarded as Notifiable workplace. And therefore, the seating area accommodate more than 10 persons, exit doors should open in the direction of exit. In case a sliding door was provided, the sliding door should be kept open during the business hour.

1. Exit door of Kitchen should open in the direction of Exit

Even the kitchen is having a capacity less than 30 persons. According to MoE 16.6(a), notifiable workplace having 10 persons or more, doors should be opened outwards; and, refer to Industrial undertaking ordinance:-

SECT.2 - "industrial undertaking" (工業經營) includes-...

(ha) the preparation of food for consumption and sale on the premises where it is prepared; (Added 77 of 1990 s. 2)...
